1. Introduction

These Terms and Conditions govern access to and use of the Jengo platform, available at jengolive.com (the “Platform”).

By using the Platform, the user fully accepts these Terms.

2. Service Description

Jengo is a digital marketplace in the food & beverage sector that allows users to:

• purchase rights to consume products and services from third-party merchants;
• access time-limited and/or quantity-limited offers;
• select products with online payment or pay directly at the venue.

The sales contract is concluded exclusively between the user and the merchant.

For online payments, Jengo acts as a collection agent on behalf of the merchant.
The payment made by the user fully discharges the user’s payment obligation towards the merchant.

3. Use of the Platform

3.1 Online Purchase

• The user completes the payment through the Platform.
• The purchase grants a right to consume the product or service at the merchant’s venue within the same reference day.
• The purchase can be used until the merchant’s closing time on that day, including hours after midnight if part of the same service period.
• For offers with specific time restrictions, the purchase must be used within the indicated time slot.
• The user receives a digital confirmation and can visit the venue to consume the product/service.

3.2 On-site Payment

• For some merchants, the Platform allows only product selection.
• Such selection does not constitute a binding order.
• Payment is made directly at the venue.
• The contract is concluded exclusively between the user and the merchant.

4. Prices and Offers

Product prices may:

• match the merchant’s listed prices;
• include temporary promotional offers.

Offers:

• may be limited in time and/or quantity;
• may be modified or removed at any time;
• are valid while supplies last.

Jengo does not guarantee continuous availability of products or offers.

5. Cashback and Promotions

Jengo may offer cashback or other promotional incentives.

Such benefits:

• are not convertible into cash;
• are non-transferable;
• may be subject to specific conditions;
• may be revoked in case of misuse.

Jengo reserves the right to cancel any benefit obtained fraudulently.

6. Payments

• Online payments are processed through third-party providers and are transferred to the merchant, net of Jengo’s commission.
• Jengo retains only its agreed commission.

For on-site payments:

• payment is made directly to the merchant;
• Jengo does not process any transaction.

7. Validity and No-Show

• Purchases are valid only for the day indicated at the time of transaction.
• The purchase can be used until the merchant’s closing time on that day, including hours after midnight if part of the same service period.
• For time-restricted offers, the purchase must be used within the specified time slot.
• If not used within the applicable time limits, the right expires.
• Failure to use the purchase does not entitle the user to a refund, except as provided in the Refund Policy.

8. Merchant Responsibility

Merchants are solely responsible for:

• product quality, safety, and compliance;
• preparation and availability;
• service delivery;
• issuance of fiscal receipts.

Jengo is not responsible for any failure by the merchant.

9. Limitation of Liability

The Platform is provided “as is”. Jengo does not guarantee:

• continuous availability;
• absence of errors or interruptions.

To the extent permitted by law, Jengo shall not be liable for indirect damages or loss of opportunity arising from use of the Platform.

10. Proper Use

Users agree to:

• use the Platform lawfully;
• avoid fraudulent activities;
• not abuse promotions or cashback.

Jengo reserves the right to suspend or limit access in case of violations.

11. Data Protection (GDPR)

Jengo processes personal data in accordance with Regulation (EU) 2016/679 (GDPR).

12. Changes to Terms

Jengo reserves the right to modify these Terms at any time.
Changes become effective upon publication on the Platform.

13. Governing Law

These Terms are governed by Italian law.
Any disputes shall fall under the jurisdiction of the consumer’s place of residence, where applicable.
